Terms and conditions of use

The following terms and conditions apply to all bookings made through this website. Please read them carefully before making and finishing a book.

On the one hand, the company acting as an intermediary in the management of service:

For the provision of the services offered, we work with providers of transport qualified and certified by the French legislation for the transfer of passengers. These act as an agency with legal capacity to offer transport services and are in possession of all licenses and permits required under the laws applicable to each of them for the implementation of this activity. The transportation service shall not be considered in any way as a tourist package in the terms established by the Council Directive 90/314/EEC of 13 June 1990, or in the terms of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users as well as other complementary legislation, and therefore the company does not operate in any case as a travel agency.

Before requesting a service offered on our website, make sure you have read and understood these Terms and Conditions, as these will govern any subsequent contract. When making a booking you confirm that you have read these terms and that you have the legal capacity to accept them in their own name and on behalf of all passengers. If you have questions about any of the contractual terms and conditions, please contact our Customer Service department before you continue with the booking process. If you do not agree with any of the obligations arising out of these Terms, unfortunately shall not make any reservation with us.

Sale of tickets to individuals and groups:

Company that acts as an intermediary in the application and contracting of ticket management services for both individuals and groups. We operate under the brand “mytaxiparis” which is our exclusive property and is managed through the website: mytaxiparis.es. For commercial purposes and customer service we have the telephone number (+34) 654 869 884, and we operate through the website mytaxipais.es and the email info@mytaxiparis.es.

For the provision of the services offered, we work with suppliers qualified and certified by the French regulations for the sale of tickets.

Before requesting a service offered on our website make sure you have read and understood these General Conditions, since these will govern any subsequent contract. By making a reservation you confirm that you have read these Conditions and that you have the legal capacity to accept them in your own name and that of all the members of the group. If you have any doubts about any of the contractual conditions, please contact our Customer Service before proceeding with the reservation process. If you do not agree with any of the obligations arising from these Conditions, unfortunately you should not make any reservation with us.

ONLINE BOOKING:

The person in charge of booking you must be over 18 years and is responsible to follow and complete all steps of the online booking system appropriately and ensure that all data provided is correct and complete. The contract with City Serving, The Company will make all the necessary arrangements for organizing and arranging of the requested services with the provider.

It is expressly prohibited to persons under the age of 18 apply for services to the company; their parents, guardians or legal responsibility will need to contact us immediately in the event that a child has reserved a service with us to proceed to its cancellation. Children should always travel in the company of an adult passenger.

Private Transport Service:

After making your booking you will receive an email confirmation of your booking. If the data is correct, you will need to reconfirm the reservation. Only then the contract will be binding on both parties. If you have not managed correctly the reservation request, there will be no proof to your e-mail, and shall be exempt from all liability the company City Serving. Sale of tickets to individuals and groups:

The contract will be binding for both parties only when you receive your reservation receipt with the tickets by email. In case you have not correctly managed the reservation request, no proof will be sent to your email. The City Serving company is exempt from any responsibility. The fact of sending the reservation email will be considered as proof of its reception by the client. The same is valid for any other informative email that we send you. For this reason it is very important that you make sure that the email address provided is correct and that you check your email inbox and spam until the moment the service starts.

TPlease note that some products require confirmation by the supplier that we obtain electronically. Normally, this happens immediately, but sometimes there may be a delay in sending you the links that contain the vouchers. Our system will keep you informed..

METHOD OF PAYMENT:

Service of private transportation:

The method of payment for the services requested will be in €. You will choose paying in advance the 10% considered as a sign of reserve corresponding to each service requested or paying the total amount in cash. We accept debit/credit card (American Express, MasterCard/Diners International, Visa), debit cards (Visa/Delta, Visa/Electron).

The cost of the service, must be paid in cash at the end of each journey.

Prices are charged in euros and any of the conversion of currency is provided as a tool of the approximation only.

Sale of tickets to individuals and groups:

The payment method corresponding to the requested services will be in € and paying in advance the total amount with a credit card or bank transfer. The amount of the contracted service must be paid no more than 48 hours before the date indicated for the use of the tickets.

Prices are charged in Euros and any currency conversion facility is provided as an approximation tool only..

TERMS OF SERVICE:

Private transport service:

The service that we offer is private and direct from the pick-up point indicated in the reservation up to the point of destination. You are solely responsible to indicate correctly your booking data. If at the moment there is an error that has not been previously addressed by you, the company and the supplier shall be exempt from all claim.

For pick up at the airport:

The supplier as a professional will make every effort to ensure that the pick-up times are scrupulously respected but cannot be guaranteed. So by accepting this Agreement, you agree that there may be a margin of difference of 30 minutes on your pickup time. When there is a greater delay of 30 minutes the company or supplier will contract to notify you of the delay. You will never find a collection before time without notice to the Customer. With this we were exempt from possible claims for breach of pick up time.

Obligations of the client:

– In case of arriving late at the pick-up previously agreed, you have an obligation to let us know if you arrive late and tell us the new pick up at least 3h prior to the transport operator to reschedule the pick-up service and you can be picked up at the new time. The change of your pick-up time will not cost extra on your final price always and when we communicated 3h before the scheduled time.

– In case of arriving late at the pick-up previously agreed and at the time agreed upon prior reservation, if you have been advised in a period of less than 3h to pick up initially agreed, and our wait is greater than the 45 minutes of courtesy that is offered, we reserve the right to request an increase of 15€ per each 30 minutes in excess of the actual pick up time.

– In case of arriving late at the pick-up previously agreed, without prior notice, the transport provider or our customer service department will attempt to contact you on the mobile telephone number you have provided. If this communication is not possible because you have not provided us with a valid number at the time of reserve, because they do not have coverage or by not responding to the call, the service will not be provided, the transport operator shall be released from its obligation to provide the service, no refund will be given and we reserve the right to request the total amount of the journey though this has not been carried out. After 30 minutes from the time listed for your collection without communication for its part of the delay, the reservation will be considered canceled and there is no possibility of any claim on their part; we reserve the right to request the total amount of the transfer though this has not been carried out.

If you cannot locate the driver of your move, it is your responsibility to contact us through the phone numbers that appear in your proof of transfer. If you do not call us to these numbers and opt for an alternative transfer, the transport provider shall be released from its obligation to provide the service.

For collections that are not in airports:

– In case of arriving late at the pick-up previously agreed, you have an obligation to let us know if you arrive late and tell us the new pick up at least 3h prior to the transport operator to reschedule the pick-up service and you can be picked up at the new time. The change of your pick-up time will not cost extra on your final price always and when we communicated 3h before the scheduled time.

– If there is any delay on your part or does not find the service provider we must receive your call within 10 minutes of the time agreed upon. After 10 minutes of courtesy there will be an increase in the final price of 10€ every ten minutes in excess of the contracted start time.

An external provider of telephony services records and stores a list of all calls received in our customer numbers; this list will be used as evidence in the event of discrepancy about whether there were calls to our contact numbers or not.

For transportation services to the airport we recommend:

– Charles de Gaulle Airport: pick up time 3h30 before the departure time of your flight.

– Orly Airport: pick up time 3h30 before the departure time of your flight.

– Beauvais Airport: pick up time 4h before the departure time of your flight.

ity Serving advise them of the time you should leave in order not to lose your flight, train, boat, or any activity that depends on the transport service offered by the provider for the arrival time. It is your responsibility to verify the scheduled pick-up time and to ensure that the resulting time of arrival to the departure terminal of the airport at least 10 minutes before the opening (closing) of the check-in desk and in no case less than 2 hours before the scheduled time of departure of the flight. City Serving reserves a margin of 40 min of traffic causes delay in the arrival time of the vehicle to the collection point without obligation to refund of the amount paid. After these 40 min the client assumes the responsibility of deciding between waiting vehicle City Serving or warn City Serving that will catch a different transport, in which case the City Serving will cancel the booking without any penalty. All of this only in the event that the customer has accepted the pick up time previously proposed by City Serving.

In either case City Serving is exempt from any claim for the payment of transport tickets, hotels or other at the possible loss of flight, train, boat or hired activity, by delay in the collection of the client or on your transfer to the place of destination due to traffic, accidents, controls, or any other cause that prevents the vehicle perform the service in normal circumstances and in time.

All transportation services contracted through City Serving are covered by the policy of civil liability of the transport provider or the company subcontracted by this, leaving City Serving free of any responsibility.

Sale of tickets to individuals and groups:

Tickets are sold subject to availability by the provider and are subject to the terms and conditions imposed by our suppliers. MyTaxiParís will not be responsible for any act or omission on the part of persons not directly employed by MyTaxiParís and has no control or responsibility over the acts of its suppliers.

MyTaxiParís not responsible for any loss, damage or expense and without prejudice to the generality of the foregoing, whether caused by strike, civil commotion, fire, war, threat of war, terrorist activity, national or nuclear disaster, delay in the delivery, adverse weather conditions, cancellation of performances, shows, sporting events, tours or temporary or permanent closure of attractions made by our suppliers for any reason or force majeure.

Under no circumstances MyTaxiParís will be responsible for any loss or consequential damage. Subject to the terms and conditions contained in this document, any liability will be limited to the price paid for the tickets.

MyTaxiParís has no control over the Theme Parks / Attractions / Entertainments / Shows / Restaurants / Sports Events / Tours and all the details and information regarding them are for guidance only.

LOST TICKETS

In most cases the printed vouchers can be reissued in case of loss if they have not been used by anyone. To do this you must contact Customer Service to indicate the loss and consulate the status of the tickets and know if it is possible to send them a copy.

ADDITIONAL STOP:

During the booking process you will have the possibility to reserve an additional stop by if you need to pick up or return keys or if your group is divided between more than one accommodation. The direction of the additional stop must be located within a radius of 1km away from the main stop. The maximum duration of this additional stop is 5 minutes and the bus stop will have an extra cost of 10€ in the final price.

MODIFICATIONS AND CANCELLATION OF THE RESERVE:

Private transport service:

The information that you have provided in your transfer request includes the collection point, the target point and the address of the accommodation in your case and the date and time of the service. Any changes that affect these or other data shall be communicated by e-mail to the address Info@mytaxibarcelona.com. Such amendments must be notified with sufficient time for the company and the supplier be able to cope with the changes. Has the time to make changes up to 12 hours prior to the completion of the service. If there is a change of urgency after the deadline of 12h must inform our Customer Service telephone 654 884 869. The customer assumes any increase in the cost of the service due to a change in the reserve.

Once the contract has been formalized, the customer must notify our Customer Service any error detected with a minimum of 12 hours in advance in relation to the shuttle service. The notifications received with less than 12 hours prior to the service of transfer shall entitle the company to cancel the contract without any penalty.

Any cancellation of the contract must be made in writing through our e-mail info@mytaxiparis.com directed to our Customer Service Department. Can be canceled both shuttle services separately as a full reserve that includes more than a free-of-charge service 48h prior to pick up time in your booking. Except for those services have been ordered and paid in advance via bank transfer. In this case will be returned to the total amount of the contracted service less the costs of managing the Transfer of return.

If you wish to cancel your booking within 48h prior to your collection, it will be returned to the 50% of the amount paid in advance and if the cancellation is made within 24h prior to the collection, they will be refunded the amount previously paid.

ERRORS IN THE WEB

If a product is displayed or loaded erroneously, be it a human error or a technical error, on the website of entradasparis.com, we reserve the right to cancel and refund any reservation made for these products before the reserved visit date. , as is our right under the law of Spain. LAST MINUTE BOOKING:

Private transport service:

We do not accept reservations that have not been requested with a minimum time of 24 hours. If you need a transport service that does not comply with this condition, please call our Customer Service Telephone 654 86 98 84 To confirm if there is availability to provide the service.

For reservations made after 22:00 hours and that the requested service is within 10 hours after we do not work to be able to confirm and to perform the service. We recommend that you book with enough time to avoid problem in the future.

LUGGAGE:

Private transport service:

Our vehicles have a maximum capacity of 8 passengers plus driver. With regard to bags, there is the ability of one suitcase per passenger for free with a maximum size of 80x54x36. At the time of booking you must inform us if you take extra luggage so you can confirm the availability of space on the vehicle. It is not necessary to declare smaller packages that can be located in the passenger’s footrest as cameras, bags or backpacks. The passenger shall be liable for any cost incurred in case you need additional vehicles for the transportation of baggage not declared.

If you have some kind of special baggage as prams (5€ extra per cart in the final price), chair of extra wheels or animals, please contact our Customer Service for availability in the car. If you do not know that it takes such special baggage, once at the point of collection the transport provider shall have the right to demand the payment of an extra vehicle if there is not enough space in your vehicle.

The acceptance of the contract and general conditions shall be considered to be a tacit agreement not to include in any case in the luggage or personal objects objects that contravene the laws of the country in which the service is provided (weapons, etc.) or they can be dangerous to a third party, nor animals unless you have reached a prior agreement and are transported in a suitable container (guide dogs accompanying persons are accepted by general rule), or objects of size, weight, expiration date or excessive fragility.

CHILD SAFETY DEVICES IN THE CAR:

All our transport operators comply with the legislation. In the case of the services performed in French, the Regulations indicates that it is necessary that the vehicles for this type of service have the corresponding security devices.

Children with height equal to or less than 135cm should always use a retaining system approved and adapted to your height and weight, always in the back seats.

All the children and babies, regardless of age, will be taken into account to determine the capacity of the vehicle to use, and therefore must be entered in the total number of passengers at the time of booking.

PASSENGERS WITH WHEELCHAIRS:

For passengers with reduced mobility with folding wheelchairs must request the service of transport through our Customer Service Team. Our vehicles are not suitable for caring for people with wheel chairs. Only accept folding wheelchairs since it is not possible to ensure the vehicle will pick you up, if not requested with notice. Passengers with reduced mobility must be able to access the vehicle by themselves or with the help of those traveling with them. The driver is prohibited from providing aid for getting on the vehicle.

THE RESPONSIBILITY OF THE COMPANY AND THE SUPPLIER:

The supplier of the service undertakes to do everything possible to get to the point of skidding at the time indicated on the reservation. We are not responsible for any damages that we are directly attributable to our negligence or those produced by accident or force majeure or having their cause in legal and administrative requirements.

Claims for compensation for accident, illness, personal injury or death caused during the transport service should be addressed to the service provider and their insurance companies, and will be subject to the jurisdiction of the country in which the incident has occurred. The sole responsibility of City Serving will be to act as an agent of mediation between the parties concerned: the customer and the service provider. Will be responsible for the fulfilment of the obligations arising out of the contract that correspond with their field of management, except when the faults observed in the transport are attributable to the customer or to a third party, to a case of force majeure or unforeseeable event or none, or eventualities such as computer viruses that may affect the reliability of the information contained on the website, and whose existence can be proven.

Therefore, the liability for any action resulting from the transportation will be attributable to the provider and their insurance companies. City Serving will not be responsible for any loss or damage caused by improper processing of the information of the reservation by the service provider. City Serving will not be responsible for any possible incidents that may occur during the provision of the service of transport.

RIGHT OF ADMISSION OF CITY SERVING AND THE SUPPLIER OF THE SERVICE:

APPLICABLE REGULATIONS:

The contract between the City Serving and the customer shall be governed by Spanish law. Any dispute which may arise between the City Serving and the client shall be subject to the jurisdiction of the Courts of Alicante.

The conditions of employment provided for here you are subject to the provisions of Law 34/2002, of 11 July, on Information Society Services and electronic commerce; the Law 7/1998, of 13 April, of the General Conditions of Contract; the Royal Decree 1906/1999, of 17 December, of the General Conditions of the Telephone or Electronic Services Contracts; the Law 15/1999, of 13 December on the Protection of Personal Data; the EC Directive 2000/31/EC of the European Parliament and of the Council of 8 June, the e-commerce directive, and the Directive 97/7/EC of the European Parliament and of the Council of 20 May 2007, on the protection of consumers in respect of contracts at a distance.

INTELLECTUAL PROPERTY RIGHTS:

The intellectual property rights of the web of City Serving are protected by national and international standards that have been granted under license. It is prohibited the use of web City Serving for any use other than the reservation of transportation services. Changing it is not allowed for the subsequent publication or reproduction in whole or in part in any field without the express authorization of City Serving.

TREATMENT OF THE INFORMATION RELATING TO THE CLIENT:

City Serving you can use the user ids from your website to collect information that will help you in the improvement of its services. When the user of the web requests budget for carrying out a service of transport and facilitates their personal data such as name, address and e-mail address, City Serving you can use these data to offer you in the future promotions and offers that may be of interest to you. In such cases the promoting and offers will be sent to the email address of the customer.

At the time that the client accepts the booking confirmation of the transport service, the customer is tacitly authorizing City Serving to communicate such data to the service provider to perform the service of transport. It is also considered that authorizes you to use such data for the process of collection and billing in the case of the service, and to provide other services that may be of interest to the client, and that will be sent by email.

In any case, all of the personal data that users of the web to communicate in the same shall be stored in automated files safeguarded whose records are declared to the Data Protection Agency. It ensures that all process shall be subject to the strictest controls relating to the security and confidentiality of the personal data provided by the customers and users of the web. 2.- CONDICIONES PARTICULARES SEGÚN DESTINO Y PROVEEDOR:

  • §1 General

These terms and conditions are an integral part of any agreement made with the provider of service with regards to the services. Furthermore, additional conditions of provider apply, which for example result from the offers and price lists of PROVIDER. The current terms and conditions shall apply. These are available here on our website for users of PROVIDER in their current version. They are applicable in the version which is valid at the time the booking is concluded. Differing, opposing or supplementary General Terms and Conditions, booking, use, payment or other conditions of the user shall be hereby objected to by PROVIDER; such user conditions shall only be an integral part of the agreement to the extent that PROVIDER has explicitly consented to their validity in writing.

PROVIDER has the right to forward requests of the user to an independently licensed limousine service provider for commercial passenger transportation.

The user is not entitled to assign claims from the contractual relationship without the explicit written consent of PROVIDER to third parties.

  • §2 Formation of the contract

The user submits a booking request by filling in the booking form and completes the booking process by clicking on the “book ride” button. Before submitting the booking, the user may change, correct and view the data at any time via the buttons “next” and “back”. The booking request can only be issued and transmitted if the user clicks on the “Accept Terms and Conditions” button.

PROVIDER then sends the user an automatic confirmation by e-mail, in which the booking is displayed again. The automatic confirmation e-mail documents that the users booking request has been received by PROVIDER, it does not constitute an acceptance of the booking request. The right of revocation does not apply.

  • §3 Content of the booking

The transportation service is derived from the booking confirmation by PROVIDER. The prices for the rides apply for a start address and a one-way ride. Additional stopovers are subject to an additional fee according to the current price structure. The rates for hourly or daily bookings are based on the requested time period. The price listed on the confirmation includes the amount of luggage stated in the booking form. For excess baggage and transport of animals, additional fees will be charged. Not registered baggage and animals not transported in a closed transport box may not be transported.

A free upgrade from the vehicle category „Business Class“ to the vehicle category „First Class“ is possible at all times (also without prior notice).

Exceptional situations such as air traffic controllers strike, bad weather conditions, etc. can also affect and may lead to longer waiting times or cancellations on short notice. These conditions need to be accepted by the user.

The number of passengers may vary and is dependent on stature and sense of comfort of the passengers. The maximum amount of passengers and luggage stated is therefore non-binding and can only be guaranteed under favourable terms. The chauffeur has the right not to accept passengers if this is required due to space and safety conditions.

Subsequent spontaneous changes of the tour by the customer are possible in general and lead to changed compensation of the tour (see § 4 terms and conditions). If the customer is not the passenger the right of spontaneous changes of the tour switches to the passenger.

In case of hourly bookings the tour has to end within the business district of the pickup address, the minimum booking duration is 2 hours.

  • §4 Compensation and Payment

The price specified in the booking confirmation is a fixed price including all taxes and fees. The guaranteed reservation price displayed in the booking procedure is calculated from the chosen vehicle class, the distance or the amount of hours, the lead time, the pick up time, and the pick up location. Further special requests such as stopovers, oversize luggage, child safety seats, etc, cannot be guaranteed and may be chargeable. In case of spontaneous changes (distance or amount of hours) the price for the actual total distance or hours (once a half hour has started it can be invoiced, i.e. starting with the first additional minute time will be rounded up to a half hour) will be calculated and charged after completion of the ride in accordance with the current price structure. If the route is shorter than the originally booked distance or a number of hours, the original amount will be charged.

In the case of transfers, there are no surcharges for waiting times up to 15 minutes. Additional waiting time of over 15 minutes caused by self-inflicted passenger behaviour will be charged per minute with a part of the hourly booking prices of the particular business district and vehicle category plus the applicable VAT. This does not apply to flight or train delays for which the customer is not culpable. In general, waiting time starts with the provided pickup time. If your ride starts at the airport, please allow for sufficient time after landing to cross the airport and collect your checked luggage. Waiting times at the baggage claim are therefore self-inflicted waiting times and have to be taken into consideration in the period of time between arrival time and pickup time, otherwise, additional costs may occur. In the case of flight delays or earlier flights the new pickup time results from the actual arrival time plus the planned period of time between the planned arrival time and the original pickup time.

In the case of hourly bookings surcharges for additional kilometres (that are the km exceeding the conventional km already included per hour and business district) are charged. The additional kilometre price orientates at the distance based prices of the booked vehicle category and business district plus the applicable VAT.

The user has four options of paying for his trip by credit card online, after transfer credit card, after transfer cash or Ideal. Any transaction fees for bank transfer payments (e.g. due to different currencies or different local bank accounts) are to be borne by the customer.

It is agreed that all invoices are transmitted electronically via web download to the respective customer.

  • §5 Cancelation and rebooking

In the case of transfer rides, a cancellation or rebooking is free of charge if there are two hours left until the booked pickup time. The total fare will be charged for cancellation or rebooking if the driver however already set off towards the pickup location and/or less than two hours is left until the booked pickup time.

Regarding hourly bookings, a cancellation or rebooking is free of charge if more than 24 hours remain between the cancellation or rebooking and the booked pickup time. 50% of the agreed fare will be charged if the driver has not yet set off towards the pickup location / or less than 24 hours remain between the cancellation or rebooking and the booked pickup time. Has the driver already set off towards the pickup location and/or less than one hour remains till the booked pickup time, the total fare will be charged in case of cancellation or rebooking.

In case of cancellation by PROVIDER already paid fares will be refunded. A claim for compensation or additional claims is excluded.

Rebookings are classified as new bookings, i.e. the rebooking is rated as a binding booking request, after which a binding booking confirmation from PROVIDER leads to the conclusion of the contract. The possibility of making short-term changes cannot be guaranteed by PROVIDER.

No-Shows without cancellation will also be charged at 100%. A No-Show is a ride in which the passenger does not appear at the agreed pickup location within 30 minutes after the pickup time unless it is a pickup at the airport or the train station. For airport pickups, your chauffeur waits up to 60 minutes for you. This time starts with the scheduled pickup time, flight and train delays or earlier flights and trains lead to a deferral of the scheduled pickup time by the planned period of time between the planned arrival time and the original pickup time. From this rule situations are excluded in which the driver and the passenger have agreed on a different pickup time by phone. If the customer has requested that the chauffeur continue waiting, the customer will be charged per minute according to the PROVIDER rates for the respective business district and the respective vehicle category.

  • §6 Behavior in the vehicle

The regulations of the relevant national Road Traffic Acts apply during the entire ride, particularly the general obligation to wear seat belts. The instructions of the chauffeur must always be followed, the driver has the responsibility to safely perform the ride and is always attentative to the welfare of his passengers. It is prohibited for passengers to open the doors when the vehicle is in motion, to throw objects from the vehicle and/or to stick out body parts or scream out of the vehicle. If you want to operate the equipment or parts of the equipment yourself, a previous instruction by the driver is required.

Smoking is prohibited in the passenger compartment of the vehicles. The costs of infringement must be fully borne by the polluters, plus deprivation of use during the repair.

Bringing food is undesirable. Bringing along and consuming alcoholic beverages is allowed only upon prior arrangement.

  • §7 Liability and warranty

PROVIDER is not liable for the correctness, reliability, completeness or timeliness of the information content and programs that are broadcasted on the website DeluxeTaxiAmsterdam.com, neither for damages therefrom, unless such damages were caused intentionally or through gross negligence by PROVIDER. This applies to all types of damage, in particular to those caused by errors, delays or interruptions of service, or problems interruption of service, technical faults of the infrastructure, incorrect content, omissions, loss or deletion of data, viruses or any damage that could arise from the use of this online service. PROVIDER is also not liable for the availability and functionality of the features offered.

PROVIDER assumes no responsibility for the content, correctness, legality and effectiveness of third-party websites, which are referred to via links from the website of PROVIDER. Opening of these links is at your own risk.

PROVIDER can not guarantee that the information provided is correct and complete and reach users or drivers in time.

PROVIDER shall not be liable for errors in the quality of access due to force majeure or events for which PROVIDER is not responsible, in particular, the failure of communication networks and gateways. PROVIDER shall provide no warranty that the website will function uninterrupted or error free or that any errors will be corrected. A liability for the services provided by the limousine service providers and the drivers is excluded.

PROVIDER shall be held liable for the careful selection and monitoring of limousine service providers only. The amount of the liability is limited to twice the fare of the ride. The user is obliged to make any complaints about the performance of the selected limousine service provider without delay to PROVIDER.

PROVIDER is not liable for theft, loss or damage to property carried in the vehicle. Compensation claims by the user expire at the end of three months after the contractual termination of the contract, provided the claims are not claimed within this period. If the user demands compensation for damages on account of non-fulfillment, the above mentioned period will be one month. After the deadline, the user may only assert claims if he has been prevented (through no fault of his own) from meeting the deadline. All claims for damages are limited to one year after their formation. This does not apply to all claims deriving from impermissible acts.

If PROVIDER discontinues its service permanently or temporarily on important grounds, this does not induce a liability.

PROVIDER is liable, regardless of the legal grounds, only for intent and gross negligence, unless it is the breach of a contractual obligation. For loss of profits, loss of savings, incidental damages and / or consequential damages, PROVIDER is only liable for willful infringement. Except for willful infringement, the liability of PROVIDER shall be limited to damages which were reasonably forseeable at the conclusion of this contract. From the foregoing limitations of liability, the liability remains unaffected for culpable injury to life, limb or health.

  • §8 Obligations of the user

The user of PROVIDER is responsible for ensuring that all the information that has been provided to PROVIDER by himself or by another person on his behalf and / or at his own cost, is complete and accurate. Each use, registration, etc. with a false, fraudulent, speculative or similar purpose is prohibited. The same applies for registration with automated procedures. The user confirms that the transportation services of PROVIDER and the limousine service providers will only be used for legal transactions.

The user indemnifies PROVIDER from all claims and expenses, including making reasonable legal fees, which result from the unlawful use of the PROVIDER service, or breach of these terms and conditions.

If the user is a merchant in terms of the Commercial Code, he has to report obvious defects to PROVIDER within 7 days after he was able to detect the fault. Otherwise, warranty claims are excluded.

The above conditions also apply to employees, legal representatives and agents of PROVIDER, where claims are asserted directly against them.

The user is liable for all damages caused by him to the vehicle and the driver over the legal limit and otherwise in accordance with the regulations.

  • §9 Data Protection

For PROVIDER the protection of privacy and personal data has top priority. Our privacy practices are in accordance with the provisions of the relevant national Data Protection Acts and other provisions of data protection on the Internet. To protect your data against accidental or intentional manipulation, loss, destruction or access by unauthorized persons we use technical and organizational security measures that we continuously improve in accordance with the technical development.

The PROVIDER website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, text files that are stored on your computer and allow an analysis of the use of the website. The user agrees to the transmission of his data (user name and phone number) to the limousine service provider for identification reasons. The user agrees to the transmission of data regarding subsequent tour changes (e.g. new routes, waiting times) from the limousine service provider to PROVIDER.

The user agrees to the disclosure of his data for the purpose of fulfillment of the contract or pursuit of legal claims to his respective contractors. The data may not be transmitted to other individuals, except if this takes place within the context of the legal provisions.

All bookings made with PROVIDER can be conveniently paid by credit card. The credit card information needs to be entered and saved only at the first booking, the information is protected from unauthorized access. PROVIDER does not store the information. For storage of the data a certified payment provider, whose systems meet the highest safety standards, such as the PCI DSS standard (Payment Card Industry Data Security Standard), is used. To increase the comfort for recurring transactions, the credit card information are saved for an extended period of up to 13 months by the authorized PCI DSS-certified payment provider.

The user is entitled to receive, upon request and without charge, information about his stored data. Furthermore, the user has the right to correct, delete or block incorrect data. Data for accounting and billing purposes are not affected by a cancelation or deletion.

PROVIDER makes an effort to store personal data by using all technical and organizational methods, so that they are not accessible to third parties. When communicating by e-mail the complete data safety can not be guaranteed by PROVIDER. We recommend sending confidential information by post.

PROVIDER is only liable for a loss of data under the liability according to §7.

  • §10 Change in service

PROVIDER at all times reserves the right to modify the applications in a reasonable manner, in consideration of the interests of the user, in order to develop them and improve their quality.

In addition, PROVIDER has the right to temporarily or permanently suspend its service on important grounds, even without informing the user individually.

  • §11 Copyright

The contents displayed on all PROVIDER platforms are protected by copyright. Your use is subject to applicable copyrights. The contents of the website may not be modified, copied, republished, transmitted, distributed or stored without the consent of PROVIDER.

  • §12 Final provisions

PROVIDER has the right to change these terms and conditions. The notification of the change is made by unilateral declaration carried out by the provision of the new terms and conditions on the PROVIDER website. PROVIDER reserves the right to request the approval of all parties when changes are made, and to terminate the user account in the case of lack of approval.

For all legal relationships between PROVIDER and the user, the law of the Federal Republic of Germany applies, excluding all international, supra-national legal systems, especially the UN sales law. Place of performance is Berlin. Place of jurisdiction for both contract parties shall be Berlin. For consumers, the place of jurisdiction stems from the respective national regulations for consumer protection.

For all legal relationships between PROVIDER and the user, the law of the Federal Republic of Germany applies, excluding all international, supra-national legal systems, especially the UN sales law. Place of performance is Berlin. Place of jurisdiction for both contract parties shall be Berlin.

In the event that any provision hereof should be ineffective, this shall not affect the validity of the remainder hereof. Is such a case, the invalid regulations should be reinterpreted or complemented so as to achieve the commercial and/or legal goal. If the invalidity is based on a performance or time specification, it shall be replaced by the by law permitted extent. In the place of the invalid or unenforceable provision or to fill the loophole, a reasonable provision shall apply which insofar as legally possible comes closest to fulfilling the original intention of the parties to the contract had they considered this point upon conclusion of the contract. In the case of a lack of performance and time specifications, the loophole is filled by the legally declared provision.

De una parte, el PROVEEDOR, y de otra parte, en adelante EL CLIENTE Considerando como tal cualquier persona física o sociedad mercantil que desee y o formalice un contrato de prestación de servicios atreves de sistemas o modos electrónicos. Acepta todas y cada uno de los acuerdos siguientes

LOS PROVEEDORES y el CLIENTE serán denominados conjuntamente las Partes e individualmente cada una de ellas la Parte. Ambas partes se reconocen la capacidad legal suficiente para actuar y EXPONEN

  1. Que el CLIENTE está interesado en la contratación de un servicio de alquiler de vehículos sin conductor y de servicios de conducción de los mismos.
  2. Que los PROVEEDORES, por separado, se dedican a la actividad empresarial de alquiler de vehículos y de prestación de servicios de conducción por parte de profesionales y ambos cuenta con la organización necesaria para prestar estos servicios adecuadamente.
  • Objeto: El presente contrato tendrá por objeto la realización de un servicio de alquiler de vehículos sin conductor y de servicios de conducción de los mismos, para usuarios del CLIENTE.
  1. Precio: Los servicios serán abonados directamente por los usuarios del CLIENTE, y estarán enmarcados dentro de los precios pactados entre el CLIENTE y los PROVEEDORES.
  2. Duración del Contrato: El presente Contrato entrará en vigor a partir del momento que se formalice la reserva finalizando a la conclusión de la misma.
  3. Condiciones del Servicio: Cada uno de los PROVEEDORES ejercerá su correspondiente actividad empresarial por cuenta propia y deberán contar, según cada caso, con el pertinente patrimonio, instrumentos, activos y organización estables; realizar la actividad bajo su propia dirección y gestión (p. ej. dar las instrucciones para la realización del trabajo) así como mantener la plantilla dentro de su propia dirección (p. ej. organizar el horario de trabajo y demás condiciones laborales, formación, etc.). Los PROVEEDORES garantizan al CLIENTE que el servicio objeto del presente contrato no es ni será en ningún caso exclusivo ni representará una parte esencial de su actividad. A efectos del presente contrato tendrán la consideración de conductores, todas aquellas personas que, con la pertinente licencia administrativa, realicen la prestación del servicio conduciendo los vehículos que el PROVEEDOR ponga a disposición del CLIENTE. La prestación de los servicios objeto del presente contrato se ajustará a lo detallado a continuación:
  • LOS PROVEEDORES pondrán a disposición del CLIENTE los vehículos y conductores que en cada momento se requiera a través del procedimiento que se indica más adelante para la prestación de un servicio de transporte urbano o interurbano a sus empleados. Para la contratación del vehículo, el PROVEEDOR garantiza que los vehículos suministrados se encuentran exclusivamente dedicados al arrendamiento sin conductor, y son propiedad de una empresa profesionalmente dedicada a esta actividad. El PROVEEDOR, si le es requerido por parte de CLIENTE, atenderá la solicitud de un vehículo dotado con acceso para personas con movilidad reducida.
  • Los servicios que prestarán los PROVEEDORES, deberán cumplir con los siguientes requisitos:
    1. Conductor con buena presencia, en poder de todos los requisitos y habilitaciones necesarias para cumplir adecuadamente con el servicio. (Permiso de conducción BTP en régimen de alta en la Seguridad Social y contratados a jornada completa). ・
    2. Dominio de catalán, castellano e ingles. ・
    3. Máxima discreción. ・
    4. Vehículos con la Póliza del Seguro de Accidentes suscrita y vigente, suficiente para cubrir todo tipo de responsabilidades.. ・
    5. Vehículos en perfecto estado mecánico, de funcionamiento y de limpieza. ・
    6. Con toda documentación en regla y al corriente de pago.
  1. LOS PROVEEDORES se comprometen a:
    1. Tener las autorizaciones, licencias o permisos administrativos, así como los títulos que en su caso le habiliten para el desarrollo de su actividad, de acuerdo con la legislación vigente en cada momento.
    2. Prestar los servicios mediante personal con cualificación profesional adecuada, así como organizar, controlar y dirigir, efectivamente, las tareas de sus empleados asignados a este contrato al objeto de conseguir la plena satisfacción de los servicios contratados.
    3. Limitar el acceso a toda la información de la que tengan conocimiento en virtud del presente contrato, solamente al personal autorizado que necesite conocer dicha información para la realización de los servicios objeto de este contrato.
    4. Prestar el servicio con vehículos adecuados a las necesidades del cliente.
    5. Disponer del consentimiento de sus empleados para entregar sus datos personales al CLIENTE para el desarrollo, control y gestión del servicio objeto del presente contrato, datos que podrán ser incorporados a los ficheros creados a tal efecto, siéndoles de aplicación los procedimientos y medidas de seguridad que tenga establecidos el CLIENTE para cada uno de ellos.
    6. Informar a su personal y colaboradores de todas y cada una de las obligaciones establecidas en el presente contrato y realizar cuantas advertencias y suscribir cuantos documentos sean necesarios con su personal y colaboradores, con el fin de asegurar el cumplimiento de tales obligaciones.
    7. Cumplir estrictamente todas las obligaciones en orden a la Seguridad Social y demás obligaciones fiscales y laborales que puedan generarse por su personal.
    8. LOS PROVEEDORES asumen la obligación de mantener vigentes, durante todo el período de duración de la prestación de servicios, unas pólizas de responsabilidad civil general con una entidad aseguradora solvente y de reconocido prestigio.
  2. Obligaciones del CLIENTE: El CLIENTE se compromete
    1. Satisfacer los importes de los servicios prestados por los PROVEEDORES en la forma descrita anteriormente Poner a disposición de los PROVEEDORES la información que considere necesaria para ejecutar los servicios objeto del presente contrato.
    2. Control y supervisión: El CLIENTE podrá mantener un régimen de supervisión y control sobre las actuaciones de los PROVEEDORES como consecuencia de este contrato, pudiendo a tal efecto:
      1. – Requerir a los PROVEEDORES en cualquier momento toda la información sobre la actividad realizada. Naturaleza Mercantil de la Prestación Las partes reconocen expresamente que las relaciones reguladas en el presente contrato son exclusivas del ámbito mercantil y quedan totalmente excluidas de la normativa y jurisdicción laboral.
    3. LOS PROVEEDORES prestarán los servicios objeto del presente contrato con sus propios trabajadores. El pago de los salarios, indemnizaciones, cuotas de la Seguridad Social, así como en definitiva, el cumplimiento de cualquier obligación de carácter laboral nacida de la relación contractual formalizada con el personal a su servicio, será única y exclusivamente por cuenta de los PROVEEDORES. Así mismo, el pago de sanciones y todo tipo de recargos por infracción de normas en el orden laboral o de la administración que les puedan ser impuestas por la Inspección de trabajo o los juzgados y tribunales de lo social serán única y exclusivamente por cuenta de los PROVEEDORES.
  • El CLIENTE quedará exonerado de cualquier responsabilidad sobre el personal de los PROVEEDORES en materia de riesgos laborales, en especial por inobservancia por parte de dicho personal de las normas de seguridad en el trabajo y de prevención de riesgos laborales establecidas por el CLIENTE. Independencia de las partes
  • El presente contrato no crea ninguna relación de dependencia, relación societaria o representación entre las Partes, las cuales mantendrán totalmente su independencia. Cada una de las Partes, en el ejercicio de su actividad, es titular de una organización empresarial autónoma y será directa o indirectamente responsable del cumplimiento de cuantas obligaciones le correspondan legalmente, en especial, en materia fiscal y laboral. Asimismo, cada una de las partes lleva a cabo todas sus actividades en su propio nombre, cuenta y riesgo, sin estar nunca autorizado para actuar en nombre de la otra Parte y sin poder asumir obligaciones de cualquier tipo en nombre o por cuenta de ésta última.
  • Todos los gastos e inversiones que le origine a cada parte su actividad serán de su exclusiva cuenta, cargo y riesgo, así como todos los impuestos y gravámenes de todo tipo como consecuencia de su actividad. Tratamiento de Datos de Carácter Personal Por lo que se refiere al tratamiento de datos de carácter personal:
    1. LOS PROVEEDORES se comprometen a guardar la máxima reserva y secreto sobre cualquier información, incluidos los datos personales a los que tenga acceso en virtud del presente contrato, en especial la información y datos propios del CLIENTE o de terceros a los que haya accedido durante la ejecución del mismo. LOS PROVEEDORES se comprometen a no divulgar dicha información, así como a no publicarla ni de cualquier otro modo, bien directamente, bien a través de terceras personas o empresas, ponerla a disposición de terceros sin el previo consentimiento por escrito del CLIENTE.
    2. De igual modo, LOS PROVEEDORES se comprometen, tras la extinción del presente contrato, a no conservar copia alguna de la información y datos a los que tenga acceso en virtud del presente contrato, salvo que su conservación esté permitida u obligada por la normativa aplicable en tanto pudieran derivarse responsabilidades al mismo por el servicio prestado, en cuyo caso, LOS PROVEEDORES deberá mantenerlos debidamente bloqueados.
    3. LOS PROVEEDORES informarán a su personal y colaboradores de las obligaciones establecidas en el presente contrato sobre confidencialidad, así como de las obligaciones relativas al tratamiento de datos de carácter personal. LOS PROVEEDORES realizarán cuantas advertencias y suscribirán cuantos documentos sean necesarios con su personal y colaboradores, con el fin de asegurar el cumplimiento de tales obligaciones.
    4. LOS PROVEEDORES reconocen que la legislación sobre protección de datos personales establece una serie de obligaciones en el tratamiento de datos de carácter personal, entre las que destaca la prohibición de realizar cesiones de datos de carácter personal sin la correspondiente autorización del titular de los datos personales. A tal efecto, LOS PROVEEDORES:
      1. a) Declaran reunir las garantías para el cumplimiento de lo dispuesto en la normativa de protección de datos personales y, en especial, en el Real Decreto 1720/2007, de 21 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley Orgánica 15/1999, de 13 de diciembre, de protección de datos de carácter personal.
      2. b) Únicamente accederán a los datos personales de clientes y demás personas físicas relacionadas con el CLIENTE si tal acceso fuese necesario para cumplir con las obligaciones establecidas para LOS PROVEEDORES en el presente contrato.
  • c) Se comprometen a:
    1. Utilizar los datos de carácter personal a los que tenga acceso única y exclusivamente para cumplir con sus obligaciones contractuales para con el CLIENTE y conforme a las instrucciones que del mismo haya recibido.
    2. Observar y adoptar cuantas medidas de seguridad sean necesarias para asegurar la confidencialidad, secreto e integridad de los datos de carácter personal a los que tenga acceso, así como a adoptar en el futuro cuantas medidas de seguridad sean exigidas por las leyes y reglamentos destinadas a preservar el secreto, confidencialidad e integridad en el tratamiento de datos personales. En especial, LOS PROVEEDORES se comprometen a cumplir y en su caso adoptar a su coste las medidas de seguridad definidas por el Real Decreto 1720/2007, de 21 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley Orgánica 15/1999, de 13 de diciembre, de protección de datos de carácter personal, o cualquier otra norma que la modifique o sustituya, como de nivel BÁSICO.
  1. Confidencialidad: A los efectos del presente contrato tendrá la consideración de información confidencial (en adelante, “Información Confidencial”) todos los datos, documentación e información de cualquier tipo revelados verbalmente, por escrito, o por cualquier otro medio de transmisión por el CLIENTE, o por cualquier persona física o jurídica que actúe en su nombre o por su cuenta, a LOS PROVEEDORES. LOS PROVEEDORES se comprometen y se obligan, ante el CLIENTE, al cumplimiento de las siguientes obligaciones:
    1. Mantener la confidencialidad y revelar la Información Confidencial sólo a aquellas personas (a) que estén directamente involucrados en el objeto del presente Contrato; (b) cuyo conocimiento de dicha información sea esencial para llevar a cabo el objeto del presente Contrato; y (c) que se comprometan a acatar las previsiones contenidas en este Contrato, especialmente en lo relativo a la Información Confidencial.
    2. No utilizar la Información Confidencial revelada para otro propósito que no sea la realización del objeto del presente contrato.
    3. No revelar a terceras personas la Información Confidencial suministrada por el CLIENTE sin el previo consentimiento escrito del mismo. Ninguna de las Partes revelará públicamente los términos del presente Contrato, sin el previo consentimiento escrito de la otra. No se considerará Información Confidencial la que, a continuación, se relaciona:
      1. Aquella que fuera de dominio Público en el momento de haberle sido revelada, o que llegue a ser pública, salvo que adquiera este carácter como consecuencia del incumplimiento por LOS PROVEEDORES de las obligaciones establecidas en el presente Contrato.
      2. Aquella que esté ya en posesión de LOS PROVEEDORES antes de ser recibida a través del CLIENTE, y no tenga el carácter de Información Confidencial.
      3. Aquella que haya sido independientemente desarrollada por LOS PROVEEDORES (según se pruebe mediante escritos de LOS PROVEEDORES o de sus asesores).
      4. Aquella que haya sido, en todo o en parte, requerida a LOS PROVEEDORES, por disposición legal o resolución judicial o de organismo público, siempre que el requerimiento sea notificado con la mayor brevedad posible al CLIENTE si ello es legalmente posible. LOS PROVEEDORES informarán a su personal y colaboradores de las obligaciones establecidas en el presente Contrato sobre confidencialidad. LOS PROVEEDORES realizarán cuantas advertencias y suscribirán cuantos documentos sean necesarios con su personal y colaboradores, con el fin de asegurar el cumplimiento de tales obligaciones. LOS PROVEEDORES responderán frente al CLIENTE si tales obligaciones son incumplidas por tales empleados y colaboradores. Las obligaciones de confidencialidad establecidas en el presente Contrato tendrán una duración indefinida, manteniéndose en vigor con posterioridad a la finalización, por cualquier causa, de la relación entre el CLIENTE y LOS PROVEEDORES.
    4. Subcontratación: El CLIENTE autoriza la subcontratación parcial de los servicios objeto del presente contrato, siempre y cuando dicha subcontratación sea hecha a una sociedad o comerciante de similares características a la de LOS PROVEEDORES y en cualquier caso la empresa subcontratada haya formalizado, previamente y por escrito antes del comienzo de la prestación de servicios, el correspondiente contrato, asumiendo todas y cada una de las obligaciones señaladas para el PROVEEDOR de que se trate en el presente contrato. Todo ello sin perjuicio de que LOS PROVEEDORES responderán frente al CLIENTE por cualquier incumplimiento de la subcontratada.
  • Cesión: Ninguna de las Partes podrá ceder total o parcialmente el presente Contrato ni las obligaciones o derechos que deriven del mismo.
  • Resolución: El presente Contrato podrá ser resuelto en cualquiera de los siguientes supuestos:
    1. Por cualquiera de las Partes en cualquier momento mediante preaviso a las otras Partes, por escrito dejando constancia de su recepción, con un mínimo de 24 horas de antelación.
    2. por cualquiera de las partes, en caso de incumplimiento del Contrato por otra parte, mediante notificación por escrito y siempre que dicho incumplimiento, si fuera subsanable, no sea subsanado en el plazo de 24 horas a partir de la fecha de la notificación a la parte incumplidora.
    3. Por incurrir alguna de las partes en supuestos de liquidación o disolución o de administración judicial o extrajudicial o de hecho.
    4. Por incumplir alguna de las Partes sus obligaciones genéricas de pago, así como si se presentara contra ella o sus órganos de administración, denuncia, querella, demanda o embargo interpuestos por terceros y ello pudiera afectar a la prestación de los servicios convenidos en este contrato, o si se produjera cualquier circunstancia que limitara la plena capacidad de dicha sociedad para administrar o disponer de sus bienes o sus negocios. La resolución de este Contrato no liberará a ninguna de las partes de las obligaciones nacidas con respecto a las otras partes durante la vigencia del Contrato ni perjudicará ningún derecho o recurso que pudiera corresponder a cualquiera de las partes por actuaciones anteriores realizadas durante la vigencia del presente contrato.
  • Efectos de la resolución: A la terminación del Contrato, LOS PROVEEDORES deberá devolver inmediatamente al CLIENTE toda la documentación, materiales y medios técnicos que estén a su disposición. Por su parte el CLIENTE, deberá abonar a LOS PROVEEDORES los servicios gestionados correctamente hasta esa fecha.
  • Ley aplicable y resolución de conflictos: Este contrato queda sujeto a la legislación española vigente en cada momento y para todas aquellas controversias y reclamaciones que se pudieran derivar, las partes se someten a la competencia y jurisdicción de los tribunales de Barcelona, con renuncia en aquello que fuera necesario renunciar a su fuero y domicilio.

Dear customer, we kindly request to take knowledge of these general terms and conditions before booking your trip wit hus.
By making a booking you automaticly declare it’s contents to be valid and applicable.
Potential dissagreements shall always be resolved on the basis of this contract.


Principles:

  • The current terms and conditions are valid throughout all reservations and bookings concluded and still to be implemented tranfers aswel, even when the booking was made verbally between the service provider and client or anyone else placing an order in the clients name.
  • All contracts which remain to be conculded are subject tot he current terms and conditions.
  • Every client has had the oppertunity to consult these general terms and conditions in advance.

Contract:

  • A placed order by the customer counts as a concluded contract between both parties to which both parties shall adhere.
  • To place an order, one must be an adult.

Conditions of use:

The shuttle service is availale to anybody who meets the following requirements:

  1. Minors:
  • Minors under the age of 12 who are travelling alone must have parental approval.
  • Minors above the age of 12 who are travelling alone must have parental approval.
  1. Passengers appearance:
    We reserve our right not to transport people who are under the influence of alcohol, drugs or who have an undecent appearance. It is the drivers responsability to determine these facts.
  2. Luggage:
    Each passenger has the possibility to take one regular sized and one smaal sized piece of luggage. For luggage with non-standard formats, please always inform us during the booking proces.
  3. Handicap:
    People with a physical or mental dissability can be transported when they reserve atleast 48 hours prior tot he implementation of the transfer and have someone accompanying them or written consent from the parents for travelling alone.
  4. Pets:
    Pets who are alive shall not be transfered unless permission has been demanded upon booking.
    n all cases the animals should be transported with the appropriate cage. The passenger is responsible for all caused damages to the vehicle or it’s accesories due to unappropriate containment of their pets or any other pet related damages.
  5. Booking:
  • The customer is responsible for booking a reservation with the correct data.
  • Online bookings will be accepted 22 hours prior tot he implementation of the transfer. Once this period has passed we can only accept bookings through e-mail. (Which are subject to availability)
  • A booking shall be deemed complete when the customer has filled in all his correct data which are demanded of him whilst booking, after which a confirmation e-mail shall follow as final confirmation.
  • To be able to guarantee a qualitative service the provider has to be in the possesion of your e-mail adress and phone number.
  • In cases of abscense on the spot, incorrect data or abscense of mobile confirmation the day before the service provider reserves it’s rights to cancel these trips without bearing any responsability of any kind of any potential damages caused by this.

 

  • Information on service rate determination:
  • All prices presented on the internet or advised through the phone are always VAT included, unless specifically mentioned otherwise.
  • The price shall be determined upon booking (Subject to verification and / or correction following computer error)
  • The passenger or someone booking for the passenger shall always receive a confirmation e-mail.
  • For a waiting time which succeeds 1 hour shall be charged with a supplementary fee of 20€ each half hour started.
  • If the client is not present when expected at the meeting point due to his/her own initiative (buying cigarettes, eatn drink,…) a supplementary waiting fee of 20€ and potential parking fees could be charged.

 

  • Payment of your booking:
  • A pre-payment shall be considered as a finished purchase, without any extra costs or services.
  • Proof of payment and responsability:

 

  • Each car is equipped with numbered receits.
  • All changes, especially the price, must be accompanied by a decent, written motivation sent to us through a registered letter at the very latest arriving 8 days before the implementation of your transfer.
  • All bills which remain to be payed 8 days after the implementation of your selected service shall be subject to intrests.
  • When there is a non-payment or refusal to pay the price shall be increased by 15% with a minimum of 50 euro’s and all potential judiciairy costs are his to bare.
  • The person who makes the booking shall remain responsible for the payment of the required services, even when among them it was differently agreed upon.
  • Cancelling and supplementary costs:
  • You may cancel and modify your required service at any time untill 24 hours of the implementation of your transfer.
  • You have the right to change your mind 14 days before the implementation of your service.
  • In cases of prepayment, you shall be reinbursed fort he full amount (- any potential service fees imposed) in the case that you cancelled your service not later than 24 hours prior tot he implementation of your transfer.

 

  • Supplmentary cancellation costs:

24 Hours before the implementation of the service : 0%
Between 12-24 hours before the implementation of the service : 50%
Between  4-12 hours before the implementation of the service : 75%
Less than 4 hours before the implementation of the service: 100%

 

  • These conditions are also applicable in cases of ‘Force Majeur’ (Terrorist attack, earthquake, flight cancelled,….)
  • Reinbursements for payments by creditcard are handled by our financial institution and thusly are free of charge.
  • All other forms of reinbursements could be subject to transction fees.
  • The client has to possibility to choose his own time of pick-up and must bare the potential consequences of his actions. (Leaving too late to the airport and missing flight is not our responsability, we always reserve our right to have 15 minutes of elbowroom)
  • Supplementary waiting fee : the customer is kindly requested to be on time at the expected meeting points at the very latest 1 hour after his plane has landed. All waiting time succeeding that hour can be charged.
  • We can’t anticipate the loss of time due to excessive checks or loss of luggage. We do ask a supplementary wainting fee in case this takes longer then the provided waiting time of 1 hour after landing. In this case, we can always make a bill so that you can try to be reinbursed by your aviaton company.

 

  • Route and Long-distance trips:
  • In all cases your driver is free to choose the route he wishes.
  • In case of a service wich exceeds 200km we count a supplementary stop of maximum 15 minutes to eat, drink, smoke, … In this case an extra 10 euro fee shall be given to the driver by the customer so that he can relax too.
  • For a service which exceeds 600km a supplementary fee of 100 euro’s will be asked so that your driver can recuperate after a long trip in a 2 star hotel.
  • The place for a break shall always be determined by the driver.

 

  • Responsabilities of the customer :
  • The passenger shall be held liable for any and all caused damages to the car, it’s accesories or anything which is considered to be not the passengers property, due to willfull misconduct or negligence of any kind, the passenger shall be considered as liable.
  • The passengers are responsible for all cases of incorrect information in case of a non co-operation or a mistake in your booking.
  • The customer is responsible for his or her own luggage and objects, and shall be responsible to make sure all his luggage is transported. In case of lost luggage due to negligance the passenger must bare the costs of sending or a supplementary fee of the amount of the route already travelled.
  • The customer is expected to review the details of the requested service the day before the implementation of the transfer. This happens around 20 :00 (GMT+1). In case you do not receive  a confirmation text message the day before, please contact us in time !
  • We kindly request the passengers to take into account any potential event of unforseenable circumstances (extreme weather conditions, closed roads, car accidents,…). Your service might be subject to later implementation or cancellation of your service.

 

  • Responsabilities of the service provider
  • The service provider pledges to act to the best of it’s competences in a responsible manner to be able to guarantee a qualitative service to the customer.

 

  • In any case, the service provider can not be held liable for loss of items, injuries, damages or unimplemented services in case of unforseable circumstances (Force Majeur) or any other case falling outside the goodwill of the service provider (Accidents, traffic jam, police controls, closed roads,…)
  • The responsability of the service provider shall not be refered to in any case of ,partially or completely , caused damages by the passenger due to willfull misconduct or negligence.
  • The service provider is not responsible for the personal belongings of the customer.
  • The service provider can not be held liable for delays, only in cases of manifest errors from the service provider.
  • In case a transfer has not been implemented and the reason for this resides within PROVIDER the client has the right to demand a reimbursement, although the amount reinbursed may never exceed the amount ( already payed) of the transfer.
  • The service provider pledges to try and resolve all the problems as quick and streamlined as possible, although he can not be held liable for damages caused outside his own will.

 

  • Applicable law and courts:
  • All dissagreements about validity, interpretation and content or implementation of this contract and the present terms and conditions are exclusively subject to the Belgian courts and thusly the Belgian judiciary system.
  • On these terms and conditions Belgian law shall apply.
  • If one or more clauses or sentences of this agreement would be declared invalid by any court , the rest of the contract shall remain functioning as a coherent undivided whole.

The service provider reserves it’s right to apply this contract in a flexible way, but also enforce it strictly if necessary.

The validity of this contract shall remain until it would be updated. In that case the customers who already booked their service before the update of the terms and conditions shall adhere to the terms and conditions previously agreed upon, but the customers who booked after the update of the terms and conditions shall adhere to the new version of these general terms and conditions.

This contract is concluded between the service provider and it’s customers.

1 Liability
The Company not will be responsible for any losses the client suffer (including for example any missed flights) due to the client failure to allow sufficient time for your journey.

1.2 In agreeing to the terms and conditions you accept that PROVIDER will in no way be held responsible for any losses, expenses or claims made by you in the event of any problem associated with the transfer.

2 Availability of Service
2.1 Vehicle model and type indicated in the reservation confirmation and on this web site are for description of the type of service. In rare cases may need to arrange a replacement vehicle should this be necessary in order to provide the transportation service. For example in the case that the vehicle booked is delayed in traffic or diversion a suitable replacement will be provided of equal or greater cost of service value. We do not guarantee that the exact model or type of vehicle specified in your confirmation email will be used for the service.

3 Payment
3.1 Cash payment is in local currency unless otherwise agreed. The credit card provided during the reservation is used for reservation validation purpose. No payment will be taken at the time of booking. If you fail to cancel your reservation in accordance with the cancellation policy a no show fee will be charged to the credit card provided as described in section 4 below.
3.2 You confirm that all details you provide to us for the purpose of booking a service are correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the service.

4 Changes and Cancellations
4.1 We will not charge you for cancellations provided that you cancel within 18 hours before the booked transfer pick up time. After this period you will need to contact the customer service directly(by phone) in order to make changes or to cancel your reservation.
4.2 Reservation cancellation policy
a) up to 4 hours before the transfer: no charge. Is not valid between 9pm – 7am
b) Less than 4 hours before the arrival: 100% of the total transfer cost may be applied.

4.3 Waiting period
a) Pick up from airports and cruise ports: the driver will be waiting for you chasing the expected landing time of your flight. Sometimes this is not possible and so in case of flight or cruise delays the first one hour of waiting is free, after, 25€ for each hours. In the event that the waiting is between 11pm and 6am the cost will be 35€ for each hours
b) Pick up from any other point: the driver will be waiting 15 minutes from the agreed pick up time.
4.4 In case of no show without communication, after the waiting period has ended (see clause 4.3 above) the full cost of the booked service(with eventual extra hours waiting) will be charged.
4.5 Any changes to your reservation must be sent to us in writing via e-mail 48 hours prior to the date of travel.
4.6 We will advise you as soon as possible to the e-mail address you have given us if for any reason your booking has to be cancelled.

5 Excess luggage
5.1 Please inform us at the time of booking if you wish to travel with excess baggage. This is to ensure that the vehicles can accommodate you. The passenger (you) shall be liable for all expenses incurred should additional vehicles be required to transport non-declared excess luggage.
Non binding Indications, please use common sense.
Sedan: max 3 passengers with 2 big luggage and 3 handbags. Or 4 passengers with handbags.
Van: number of passengers indicated and 1 big luggage and 1 handbag for each one.

6 Force Majeure
6.1 PROVIDER cannot be held liable for delays, changes or cancellation of service due to force majeure, or to other circumstances that are unforeseeable or beyond the our control, such as accidents suffered by third parties on the transfer route, police checkpoints, acts of terrorism, extreme weather conditions etc.

7 Intellectual Property Rights
7.1 Copyrights, trademarks and other intellectual property rights of the website have been granted under license to Alltransfersinrome and are protected by national and international regulations governing intellectual property.
7.2 Use of our website content by third parties for any purpose other than booking transfers is prohibited, including the modification, subsequent publication and total or partial reproduction or representation of the same without the express consent of PROVIDER.

8 Other
8.1 If you encounter any problems with the service you book on our website, have any complaints or comments please contact us and we’ll endeavor to investigate the matter.

De una parte la EMPRESA actuando como intermediaria en la gestión del servicio. De otra parte: EL PROVEEDOR, agente encargado de ofrecer el servicio contratado. Y de otra: EL CLIENTE, persona que gestiona la solicitud de reserva y abona el importe correspondiente.

A la hora de gestionar la reserva nos referiremos a “Total de Pasajeros” a todos los pasajeros incluidos en la reserva sean o no expresamente nombrados y “Titular de la reserva” nombre de uno de los pasajeros que forme parte de la reserva.

MANIFIESTAN

Que todas las partes están interesadas en celebrar un contrato para la prestación de un servicio de transporte privado de viajeros con conductor o compra de entradas para realizar actividades, con arreglo a las cláusulas establecidas previamente por empresa y proveedor, y aceptadas conscientemente por el cliente.

QUIENES SOMOS

Servicio de transporte privado:

Empresa que actúa como intermediaria entre proveedor y cliente en la solicitud y contratación de servicios de transporte tanto para particulares como para grupos. Para la prestación de los servicios ofertados, trabajamos con proveedores de transporte cualificados y certificados por la normativa francesa para el traslado de pasajeros. Estos actúan como agencia con capacidad legal para ofrecer servicios de transporte y están en posesión de todas las licencias y permisos necesarios según la legislación aplicable a cada uno de ellos para la realización de esta actividad. El servicio de transporte no se considerará en ningún caso como un paquete turístico en los términos establecidos por la Directiva del Consejo 90/314/EEC, de 13 de Junio de 1990, ni en los términos del Real Decreto Legislativo 1/2007, de 16 de Noviembre, que aprueba el texto revisado de la Ley General para la Protección de Consumidores y Usuarios así como otras leyes complementarias, y por lo tanto la empresa no opera en ningún caso como una agencia de viajes.

Antes de solicitar un servicio ofrecido en nuestro sitio web asegúrese de haber leído y comprendido estas Condiciones Generales, puesto que estas regirán cualquier contrato posterior. Al realizar una reserva usted confirma que ha leído estas Condiciones y que dispone de la capacidad legal para aceptarlas en su propio nombre y en el de todos los pasajeros. RESERVA ONLINE

La persona encargada de efectuar la reserva debe ser mayor de 18 años y es responsable de seguir y cumplimentar todos los pasos del sistema de reserva online de forma adecuada y asegurarse de que todos los datos aportados son correctos y completos. Formalizado el contrato con PROVEEDOR, la empresa realizará todos los trámites necesarios para organizar y disponer de los servicios solicitados con el proveedor.

Queda expresamente prohibido a las personas menores de edad solicitar servicios a la empresa; sus padres, tutores o responsables legales deberán contactarnos inmediatamente en el caso de que un menor haya reservado un servicio con nosotros para proceder a su cancelación. Los menores siempre deberán viajar en compañía de un pasajero adulto.

Servicio de transporte privado:

Después de realizar su reserva usted recibirá por correo electrónico un comprobante de la reserva. Si los datos son correctos, usted deberá reconfirmar la reserva. Solo entonces el contrato será vinculante para ambas partes. En caso de que no haya gestionado de forma correcta la solicitud de reserva, no le llegará ningún justificante a su correo, quedando exenta de toda responsabilidad la empresa PROVEEDOR. El hecho de mandar el correo electrónico de reserva se considerará como prueba de su recepción por parte del cliente. Lo mismo es válido para cualquier otro correo informativo que le hagamos llegar. Por este motivo es de suma importancia que se asegure que la dirección de correo electrónico facilitada es correcta y que revise su carpeta de entrada y spam del correo electrónico hasta el momento del inicio del servicio de traslado.

El precio para cada trayecto es cerrado previa reserva. Para ello, es necesario que seleccione correctamente cuál es su zona de destino o recogida. Si usted no selecciona la zona correctamente y por ello no se le aplica el precio adecuado, el proveedor del servicio tiene derecho a exigirle que abone la diferencia hasta el importe correcto. Para evitar estos posibles incidentes es aconsejable que si no tiene claro que zona debe de seleccionar para el servicio llame a nuestro equipo de atención al cliente.

  • La Defense:código postal 92400
  • Eurodisney y alrededores:hoteles del parque y asociados.

En el caso de no recibir reconfirmación de la reserva, la empresa puede considerar anulada dicha reserva ante la posibilidad de una solicitud de reserva fraudulenta y evitar posibles pérdidas económicas. El envío por nuestra parte del comprobante de reserva supone para nosotros un contrato de responsabilidad y seriedad como empresa con el cliente. Por lo que exigimos al solicitante la misma seriedad y responsabilidad ante el trabajo de otros.

Deberá imprimir y tener listos los comprobantes de reserva para presentarlos al proveedor de transporte de manera que el conductor pueda examinarlos. Si el titular de la reserva no presenta el comprobante, es posible que el operador de transporte no preste el servicio. Le recomendamos que imprima y lleve consigo todas las comunicaciones mantenidas con la empresa además del comprobante de traslado.

Por otro lado, si llegado el momento el proveedor de transporte no puede prestar el servicio solicitado por causas ajenas a su voluntad, el cliente será informado lo antes posible, quedando la empresa liberada de cualquier obligación para con el cliente.

CONDICIONES DEL SERVICIO

El servicio que le ofrecemos es privado y directo desde el punto de recogida indicado en su reserva hasta el punto de destino. Usted es el único responsable de indicar correctamente los datos de su reserva. Si llegado el momento existe un error que no ha sido subsanado previamente por usted, la empresa y el proveedor quedarán exentos de toda reclamación.

  1. Para recogidas en el aeropuerto:

El proveedor del servicio realizará la recogida de los pasajeros 20 minutos después de la hora de la llegada de su vuelo en la zona de recepción de pasajeros con un cartel a su nombre. El chófer se esforzara al máximo para asegurar que las horas de recogida se respeten escrupulosamente pero no podemos garantizarlas. Por lo que aceptando este contrato, acepta que puede haber un margen de diferencia de 25 minutos en su hora de recogida por posibles motivos ajenos a la voluntad tanto de la empresa como del proveedor del servicio como puede ser retención por manifestaciones, accidentes, controles de seguridad u otros. Cuando se sepa que puede que haya un retraso mayor de 25 minutos desde la hora de recogida, la empresa o el proveedor se pondrán en contracto para avisarle de la demora y usted decidirá si desea marcharse o esperar a la llegada del vehículo. Nunca se realizará una recogida antes de hora sin previo aviso al cliente. Sí usted decide marcharse antes de la llegada del vehículo, tanto la empresa como el proveedor quedan exentos de posibles reclamaciones por incumplimiento de hora de recogida. Sí se marcha antes de transcurrir los 45 minutos de margen espera entre la hora de recogida y el tiempo de seguridad establecido y aceptado en este contrato por usted, la emrpesa no se hace responsable de ninguna reclamacion por su parte, ni la devolución del importe abonado previamente.

 

Obligaciones del cliente: En caso de saber que va a llegar con retraso al punto de recogida previamente acordado, usted tiene la obligación de avisarnos si llega con retraso e indicarnos la nueva hora de recogida al menos 3h antes para que el operador de transporte reprograme el servicio de recogida y usted pueda ser recogido a la nueva hora. El cambio de hora de su recogida no supondrá un coste extra en su precio final siempre y cuando nos lo haya comunicado 3h antes de la hora prevista.

 

En caso de saber que va a llegar con retraso al punto de recogida previamente acordado y a la hora acordada previa reserva, si usted ha avisado en un plazo inferior a 3h de la hora de recogida acordada inicialmente, y nuestra espera es mayor a los 45 minutos de cortesía que se le ofrecen, nos reservamos el derecho a exigir un incremento de 15€ por cada 30 minutos que exceda la hora de recogida.

En caso de saber que va a llegar con retraso al punto de recogida previamente acordado, sin habernos avisado previamente, el proveedor de transporte o nuestro servicio de Atención al Cliente intentarán ponerse en contacto con usted a través del número de teléfono móvil que nos haya proporcionado. Si esta comunicación no fuera posible porque usted no nos ha proporcionado un número válido en el momento de reservar, por no tener cobertura o por no responder a la llamada, el servicio no se prestará, el operador de transporte quedará liberado de su obligación de prestar el servicio, no se reembolsará ningún importe y nos reservamos el derecho a exigir el importe total del trayecto aunque éste no se haya realizado. Pasados 30 minutos desde la hora indicada para su recogida sin comunicación por su parte del retraso, la reserva se considerará cancelada y no habrá posibilidad de reclamación alguna por su parte; nos reservamos el derecho a exigir el importe total del traslado aunque éste no se haya realizado.

Si usted no localiza al conductor de su traslado, es responsabilidad suya ponerse en contacto con nosotros a través de los números de teléfono facilitados que aparecen en su comprobante de traslado. Si no nos llama a esos números y opta por un traslado alternativo, tanto la empresa como el proveedor de transporte quedarán liberados de su obligación de prestar el servicio.

  1. Para recogidas que no son en aeropuertos:

En caso de llegar con retraso al punto de recogida previamente acordado, usted tiene la obligación de avisarnos si llega con retraso e indicarnos la nueva hora de recogida al menos 3h antes para que el operador de transporte reprograme el servicio de recogida y usted pueda ser recogido a la nueva hora. El cambio de hora de su recogida no supondrá un coste extra en su precio final siempre y cuando nos lo haya comunicado 3h antes de la hora prevista.

Si existe algún retraso por su parte o no encuentra al proveedor del servicio debemos recibir su llamada en los diez minutos siguientes a la hora pactada. Pasados los 10 minutos de cortesía habrá un incremento en el precio final de 10€ cada diez minutos que exceda de la hora inicial contratada.

Un proveedor externo de servicios de telefonía registra y almacena un listado de todas las llamadas recibidas en nuestros números de Atención al Cliente; este listado se utilizará como prueba en caso de discrepancia sobre si se realizaron llamadas a nuestros teléfonos de contacto o no.

Para servicios de transporte hacia el aeropuerto le recomendamos:

  • Aeropuerto de Charles de Gaulle: hora recogida 3h30 antes de la hora de salida de su vuelo.
  • Aeropuerto de Orly: hora recogida 3h30 antes de la hora de salida de su vuelo.
  • Aeropuerto de Beauvais: hora recogida 4h30 antes de la hora de salida de su vuelo.

El PROVEEDOR les aconseja sobre la hora a la que deberían de salir para no perder su vuelo, tren, barco o cualquier actividad que dependa del servicio de transporte ofrecido por el proveedor para la llegada a tiempo. Usted es responsable de comprobar la hora de recogida prevista y de asegurarse que la hora resultante de llegada a la terminal de salidas del aeropuerto sea como mínimo 10 minutos antes de la apertura (no del cierre) del mostrador de facturación y en ningún caso con menos de 2 horas de antelación respecto a la hora prevista de salida del vuelo. PROVEEDOR se reserva un margen de 40 min de retraso por causas de tráfico en la hora de llegada del vehículo al punto de recogida sin obligación de devolución del importe abonado. Pasados esos 40 min el cliente asume la responsabilidad de decidir entre esperar al vehículo de PROVEEDOR o avisar a PROVEEDOR de que cogerá un transporte diferente, en cuyo caso el PROVEEDOR le cancelara la reserva sin penalización alguna. Todo ello solo en el caso de que el cliente haya aceptado la hora de recogida propuesta previamente por el PROVEEDOR. Sí usted no acepta la hora de recogida que recomienda el PROVEEDOR cuando tenga un punto de destino un aeropuerto, es usted el único responsable de las posibles consecuencias.

En cualquiera de los casos PROVEEDOR queda exenta de toda reclamación para el pago de billetes de transporte, hoteles u otros ante la posible pérdida del vuelo, tren, barco o actividad contratada, por retraso en la recogida del cliente o en su traslado hasta el lugar de destino debido al tráfico, accidentes, controles o cualquier otra causa que impida al vehículo realizar el servicio en circunstancias normales y en los tiempos previstos.

Todos los servicios de transporte contratados a través del PROVEEDOR están cubiertos por la póliza de responsabilidad civil del proveedor de transporte o de la empresa subcontratada por este, quedando el PROVEEDOR exenta de toda responsabilidad.

PARADA ADICIONAL

Durante el proceso de reserva tendrá la posibilidad de reservar una parada adicional por si necesita recoger o devolver unas llaves o si su grupo está repartido entre más de un alojamiento. La dirección de la parada adicional debe estar ubicada dentro de un radio de 1km de distancia de la parada principal. La duración máxima de esta parada adicional será de 5 minutos y dicha parada tendrá un coste extra de 10€ en el precio final.

MODIFICACIONES O CANCELACIÓN DE SU RESERVA

La información que usted nos ha facilitado en su solicitud de traslado incluye el punto de recogida, el punto destino y la dirección del alojamiento en su caso y fecha y hora del servicio. Cualquier cambio que afecte a estos o a otros datos deberá comunicarse por correo electrónico. Dichas modificaciones deben de notificarse con el tiempo suficiente para que la empresa y el proveedor puedan hacer frente a las modificaciones. Dispone de tiempo para hacer modificaciones hasta 12 horas antes de la realización del servicio. Si existe una modificación de urgencia pasado el plazo de 12h deberá de comunicarlo a nuestro teléfono de Atención al Cliente. El cliente asume cualquier incremento en el coste del servicio debido a un cambio en la reserva.

Una vez el contrato se haya formalizado, el cliente deberá notificar a nuestro servicio de Atención al Cliente cualquier error detectado con un mínimo de 12 horas de antelación respecto al servicio de traslado correspondiente. Las notificaciones recibidas con menos de 12 horas de antelación respecto al servicio de traslado darán derecho a la empresa a cancelar el contrato sin penalización alguna.

Cualquier cancelación del contrato deberá realizarse por escrito a través de nuestro correo electrónico dirigido a nuestro departamento de Atención al Cliente. Pueden cancelarse tanto servicios de traslado por separado como una reserva completa que incluya más de un servicio sin coste alguno antes de las 48h de la hora de recogida en su reserva. Excepto para aquellos servicios que se hayan solicitado y pagado previamente a través de transferencia bancaria o paypal. En este caso será devuelto el importe total del servicio contratado menos los gastos de gestión de realizar la devolución.

Si desean realizar la cancelación de su reserva dentro de las 48h anteriores a su recogida, le será devuelto el 50% del importe abonado previamente y si la cancelación se realiza dentro de las 24h anteriores a la recogida, no les será devuelto el importe abonado previamente.

RESERVA ÚLTIMA HORA

No aceptamos reservas que no se hayan solicitado con un tiempo mínimo de 24 horas. Si usted necesita un servicio de transporte que no cumpla con esta condición, por favor llame a nuestro teléfono de Atención al Cliente para que le puedan confirmar si existe disponibilidad de ofrecerle el servicio.

Para las reservas que se realicen después de las 22:00 horas y que el servicio solicitado sea dentro de las 10 horas posteriores no nos comprometemos a poder confirmar y realizar el servicio. Le recomendamos que haga su reserva con tiempo suficiente para que no haya problemas de disponibilidad.

EQUIPAJE

Nuestros vehículos disponen de una capacidad máxima de 8 pasajeros + conductor. En cuanto a maletas, existe la capacidad de una maleta por pasajero gratis con un tamaño máximo de 80x54x36. En el momento de realizar la reserva debe de informarnos si llevará equipaje extra para que se le pueda confirmar disponibilidad de espacio en el vehículo. No es necesario declarar bultos más pequeños que puedan ser ubicados en el reposapiés del pasajero como cámaras fotográficas, bolsos o mochilas pequeñas. El pasajero se hará responsable de cualquier coste en que se incurra en caso de necesitar vehículos adicionales para el transporte de equipaje no declarado.

Si llevan algún tipo de equipaje especial como carritos de niños (5€ extra por carrito en el precio final), silla de ruedas extra o animales, por favor, pónganse en contacto con nuestra Atención al Cliente para consultar disponibilidad en el coche. Si usted no avisa de que lleva dichos equipajes especiales, una vez llegados al punto de recogida el proveedor de transporte tendrá todo el derecho a exigirle el abono de solicitar un vehículo extra si no hay espacio suficiente en su vehículo.

Su aceptación del contrato y de las Condiciones Generales se considerará un acuerdo tácito de no incluir en ningún caso en el equipaje ni en los objetos personales objetos que contravengan la legislación del país en el que se presta el servicio (armas, etc.) o que puedan ser peligrosos para un tercero, ni animales a no ser que se haya llegado a un acuerdo previo y sean transportados en un contenedor adecuado (los perros guía acompañantes se aceptan por norma general), ni objetos de tamaño, peso, caducidad o fragilidad excesivos.

El transporte del equipaje y otros objetos personales corre por su cuenta y riesgo y en ningún caso seremos responsables de posibles daños o pérdidas. Este riesgo de daño o pérdida debería ser cubierto mediante la contratación de un seguro por parte del cliente antes del inicio del viaje.

DISPOSITIVOS DE SEGURIDAD PARA NIÑOS EN EL COCHE

Todos nuestros vehículos cumplen con la legislación vigente. En el caso de los servicios realizados en Francia, la normativa vigente indica que es necesario que los vehículos para este tipo de servicio dispongan de los dispositivos de seguridad correspondientes.

Los menores con altura igual o inferior a 135cm deberán utilizar siempre un sistema de retención homologado y adaptado a su talla y peso, siempre en los asientos posteriores.

  • Grupo 0 y 0+:
  • 0 a 13 kg aprox, hasta 18 meses aprox
  • Grupo 1:
  • 9 a 18 kg aprox, de 1 año a 4 años aprox
  • Grupo 2 y 3:
  • 15 a 36 kg aprox, de 4 a 12 años aprox
  • Cinturón:
  • A partir de 135 cm, mayores de 12 años aprox

Todos los niños y bebés, independientemente de su edad, se tendrán en cuenta para determinar la capacidad del vehículo a utilizar, y por lo tanto deben ser introducidos en el número total de pasajeros en el momento de realizar la reserva.

PASAJEROS CON SILLAS DE RUEDAS

Los pasajeros con movilidad reducida con sillas de ruedas plegables deberán de solicitar el servicio de transporte a través de nuestro servicio de Atención al Cliente. Nuestros vehículos no están adecuados para atender a personas con sillas de ruedas fijas. Solamente se aceptan sillas de ruedas plegables ya que no se puede asegurar el vehículo que les recogerá, si no se ha solicitado con previo aviso. Los pasajeros con movilidad reducida deberán poder acceder al vehículo por sí mismos o con ayuda de quienes viajen con ellos. El conductor tiene prohibido ofrecer ayuda para subir a dicho vehículo.

RESPONSABILIDAD DE LA EMPRESA Y PROVEEDOR

El proveedor del servicio se compromete a hacer todo lo posible para llegar al punto de recogía a la hora indicada en la reserva. Llegada la hora acordada y el coche todavía no ha podido llegar por cualquier motivo ajeno a él como puede ser el tráfico, retenciones, controles de seguridad u otros casos, tanto el proveedor del servicio como PROVEEDOR le mantendrán informado en todo momento de la situación real del vehículo. De esta forma usted como usuario valorará y tomará la decisión de esperar al coche o tomar otra alternativa diferente. La Empresa y el proveedor quedan exentos de toda posible reclamación ante las consecuencias producidas por la decisión tomada por parte del cliente.

El responsable del vehículo utilizado actuando como proveedor para el transporte de los servicios estará incluido en la garantía de responsabilidad civil de la póliza de seguro del proveedor de servicios. Por lo que, PROVEEDOR se hace responsable solamente por aquellos daños o perjuicios que sean consecuencia atribuible a su incumplimiento o negligencia, y como máximo por el importe total pagado por usted. No somos responsables de daños y perjuicios que no nos sean directamente atribuibles a nuestra negliglencia o de aquellos producidos por accidente o fuerza mayor o que tengan su causa en exigencias legales y administrativas.

Las reclamaciones de indemnización por accidente, enfermedad, lesiones personales o muerte causadas durante el servicio de transporte deberán dirigirse al proveedor de servicios y sus compañías de seguros, y estarán sujetos a la jurisdicción del país en el que se haya producido el siniestro. La única responsabilidad de PROVEEDOR será la de actuar como agente de intermediación entre las partes interesadas: el cliente y el proveedor de servicios. Será responsable del cumplimiento de las obligaciones derivadas del contrato que se correspondan con su ámbito de gestión, salvo cuando las faltas observadas en el transporte sean imputables al cliente o a un tercero, a un caso de fuerza mayor o acontecimiento de carácter imprevisible o insuperable, o a eventualidades tales como virus informáticos que pudieran afectar a la fiabilidad de la información contenida en la web, y cuya existencia se pueda probar.

Por lo tanto, la responsabilidad por cualquier acción resultante del servicio de transporte será atribuible al proveedor de servicios y a sus compañías de seguros. El PROVEEDOR no será responsable de las posibles pérdidas o daños ocasionados por un procesamiento incorrecto de la información de la reserva por parte del proveedor de servicios. El PROVEEDOR no será responsable de las posibles incidencias que se pudieran producir durante la prestación del servicio de transporte.

Quedamos completamente exentos de cualquier responsabilidad en el caso de pérdida u olvido de algún objeto en el vehículo. Actuando de buena fe, se les pondrá en contacto con el proveedor directamente para que lleguen a un acuerdo para la devolución correspondiente.

DERECHO DE ADMISIÓN

El envío al cliente del comprobante de la reserva implicará que el cliente acepta tácitamente el derecho del proveedor de servicios a negarse a transportar a cualquier pasajero cuyas circunstancias o comportamiento pudieran ser considerados peligrosos para los demás pasajeros o para el conductor o puedan perjudicar al vehículo, por estar bajo la influencia del alcohol, drogas u otros. Durante el servicio de transporte en el vehículo no se podrá fumar, consumir bebidas alcohólicas o narcóticos.

NORMATIVA APLICABLE

La contratación entre PROVEEDOR y el cliente se regirá por la legislación española. Cualquier controversia que pueda surgir entre PROVEEDOR y el cliente estará sujeta a la jurisdicción de los Tribunales de Alicante.

Las condiciones de contratación previstas aquí estás sujetas a lo previsto en la Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de comercio electrónico; la Ley 7/1998, de 13 de abril, de las Condiciones Generales de Contratación; el Real Decreto 1906/1999, de 17 de diciembre, de las Condiciones Generales del Teléfono o Servicios Electrónicos Contratos; la Ley 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal; la Directiva CE 2000/31/CE del Parlamento Europeo y del Consejo, de 8 de junio, la Directiva sobre el comercio electrónico, y la Directiva 97/7/CE del Parlamento Europeo y del Consejo, de 20 de mayo, sobre la Protección de los Consumidores en materia de Contratos a Distancia.

DERECHOS DE PROPIEDAD INTELECTUAL

Los Derechos de Propiedad Intelectual de la web de PROVEEDOR están protegidos por las normas nacionales e internacionales puesto que se han concedido bajo licencia. Está prohibido el uso de la web de PROVEEDOR para cualquier uso diferente a la reserva de servicios de transporte. Se prohíbe su modificación para la posterior publicación, o su reproducción total o parcial en cualquier ámbito sin que medie autorización expresa de PROVEEDOR.

TRATAMIENTO DE LA IMFORMACION RELATIVA AL CLIENTE

El PROVEEDOR podrá́ utilizar los identificadores de usuario de su web para recopilar información que le ayudará en la mejora de sus servicios. Cuando el usuario de la web pide presupuesto para la realización de un servicio de transporte y facilita sus datos personales tales como nombre y dirección de correo electrónico, PROVEEDOR podrá́ conservar y utilizar esos datos de forma indefinida para ofrecerle en el futuro promociones y ofertas que puedan ser de su interés. En esos casos las promocionas y ofertas se enviarán a la dirección de correo electrónico facilitado por el cliente.

En el momento en que el cliente acepta la confirmación de la reserva del servicio de transporte, el cliente está autorizando tácitamente a PROVEEDOR a comunicar esos datos al proveedor de servicios para llevar a cabo el servicio de transporte. También se considerará que le autoriza a utilizar esos datos para el proceso de cobro y en su caso facturación del servicio, y para ofrecerle otros servicios que puedan ser de interés para el cliente y que se le enviarían por correo electrónico.

En cualquier caso todos los datos personales que los usuarios de la web comunicasen en la misma serán conservados de forma indefinida en el tiempo en ficheros automatizados salvaguardados cuyos registros son declarados a la Agencia de Protección de Datos. Se garantiza que todo el proceso estará sujeto a los más estrictos controles relativos a la seguridad y confidencialidad de los datos personales facilitados por los clientes y usuarios de la web.

En el supuesto de que un cliente o usuario desease dejar de recibir en el futuro información sobre las promociones y ofertas que PROVEEDOR pudiera enviarle considerando que son de su interés, una simple solicitud por correo electrónico en este sentido será suficiente para el cese de la actividad. De igual modo si lo desea puede solicitar por correo electrónico que se le comuniquen cuáles son sus datos personales que obran en poder del PROVEEDOR, pudiendo solicitar una modificación de los mismos.

QUEJAS

El Reglamento UE n° 524/2013 sobre la resolución de litigios en línea en materia de consumo entro en vigor el 09.01.2016. ODR (Online Dispute Resolution). Este Reglamento busca establecer un procedimiento judicial independiente, imparcial, transparente, eficaz, rápido y justo para resolver los diversos litigios derivados de la venta en línea internacional de mercancías y servicios entre los países de la UE.

Usted tiene todo el derecho a comunicarnos si el servicio que está recibiendo o ha recibido no cumple con sus expectativas. Dispone del servicio de Atención al Cliente de forma telefónica o mediante email para comunicarnos sus quejas y malestares, y poderle ofrecer solución lo antes posible, siempre dentro de nuestras posibilidades. Las quejas recibidas una vez concluido el servicio de transporte y que no se nos notificaron durante el transcurso del traslado pueden no ser aceptadas ya que no se nos ha dado la oportunidad de prestar ayuda o intervenir de alguna manera. 1 Liability
The Company not will be responsible for any losses the client suffer (including for example any missed flights) due to the client failure to allow sufficient time for your journey.

1.2 In agreeing to the terms and conditions you accept that PROVIDER will in no way be held responsible for any losses, expenses or claims made by you in the event of any problem associated with the transfer.

2 Availability of Service
2.1 Vehicle model and type indicated in the reservation confirmation and on this web site are for description of the type of service. In rare cases may need to arrange a replacement vehicle should this be necessary in order to provide the transportation service. For example in the case that the vehicle booked is delayed in traffic or diversion a suitable replacement will be provided of equal or greater cost of service value. We do not guarantee that the exact model or type of vehicle specified in your confirmation email will be used for the service.

3 Payment
3.1 Cash payment is in local currency unless otherwise agreed. The credit card provided during the reservation is used for reservation validation purpose. No payment will be taken at the time of booking. If you fail to cancel your reservation in accordance with the cancellation policy a no show fee will be charged to the credit card provided as described in section 4 below.
3.2 You confirm that all details you provide to us for the purpose of booking a service are correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the service.

4 Changes and Cancellations
4.1 We will not charge you for cancellations provided that you cancel within 18 hours before the booked transfer pick up time. After this period you will need to contact the customer service directly(by phone) in order to make changes or to cancel your reservation.
4.2 Reservation cancellation policy
a) up to 4 hours before the transfer: no charge. Is not valid between 9pm – 7am
b) Less than 4 hours before the arrival: 100% of the total transfer cost may be applied.

4.3 Waiting period
a) Pick up from airports and cruise ports: the driver will be waiting for you chasing the expected landing time of your flight. Sometimes this is not possible and so in case of flight or cruise delays the first one hour of waiting is free, after, 25€ for each hours. In the event that the waiting is between 11pm and 6am the cost will be 35€ for each hours
b) Pick up from any other point: the driver will be waiting 15 minutes from the agreed pick up time.
4.4 In case of no show without communication, after the waiting period has ended (see clause 4.3 above) the full cost of the booked service(with eventual extra hours waiting) will be charged.
4.5 Any changes to your reservation must be sent to us in writing via e-mail 48 hours prior to the date of travel.
4.6 We will advise you as soon as possible to the e-mail address you have given us if for any reason your booking has to be cancelled.

5 Excess luggage
5.1 Please inform us at the time of booking if you wish to travel with excess baggage. This is to ensure that the vehicles can accommodate you. The passenger (you) shall be liable for all expenses incurred should additional vehicles be required to transport non-declared excess luggage.

Sedan: max 3 passengers with 2 big luggage and 3 handbags. Or 4 passengers with handbags.
Van: number of passengers indicated and 1 big luggage and 1 handbag for each one.

6 Force Majeure
6.1 PROVIDER cannot be held liable for delays, changes or cancellation of service due to force majeure, or to other circumstances that are unforeseeable or beyond the our control, such as accidents suffered by third parties on the transfer route, police checkpoints, acts of terrorism, extreme weather conditions etc.

7 Intellectual Property Rights
7.1 Copyrights, trademarks and other intellectual property rights of the website have been granted under license to Alltransfersinrome and are protected by national and international regulations governing intellectual property.
7.2 Use of our website content by third parties for any purpose other than booking transfers is prohibited, including the modification, subsequent publication and total or partial reproduction or representation of the same without the express consent of PROVIDER.
